It is about a boy who left home with a bookbag, two cell phones \u2014 one belonging to his mother \u2014 and never came back.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<h2>A wrongful suspicion at the center of the case<\/h2>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Prosecutors have been clear from the start: Carmack-Belton did not steal anything from the Shell gas station at 7441 Parklane Road.<\/p>\n<p><!--]--><!--[--><\/p>\n<p>In opening statements Wednesday, 5th Circuit Solicitor Byron Gipson framed the case in stark terms for the panel of 12 jurors, a mix of young and middle-aged men and women of various races.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cWhat is the value of human life?\u201d Gipson asked, according to The State\u2019s coverage of opening statements. \u201cRick Chow, the defendant in this case, determined that Cyrus Carmack-Belton\u2019s life was worth less than four bottles of water.\u201d<\/p>\n<p><!--]--><!--[--><\/p>\n<p>The store had what investigators described as an \u201cintricate\u201d and \u201cexpensive\u201d video surveillance system. After reviewing the footage, prosecutors determined Cyrus had not taken anything. He can be seen on video casually walking out of the store after being confronted about a suspected theft by Alice Chow \u2014 Rick Chow\u2019s wife \u2014 and the couple\u2019s son, Andy Chow.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>What happened next is what brought this case to trial. Rather than calling police or reviewing the surveillance system they had on hand, Rick and Andy Chow chased Cyrus 130 yards from the gas station, down Springtree Drive, toward an apartment complex.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Cyrus ran so hard he lost a shoe and dropped the two cell phones he was carrying.<\/p>\n<p><!--]--><!--[--><\/p>\n<h2>What the defendant\u2019s son told the jury<\/h2>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>On Friday, the defense called Andy Chow, now 23, as its first witness. He spent nearly three hours on the stand, as defense attorney Shaun Kent walked him through his account of the chase.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Andy told jurors he first noticed Carmack-Belton while stocking shelves. His mother asked the teen to leave his bookbag at the front of the store, to which he complied.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cHe goes to the water cooler, and that\u2019s when I think he pockets the water,\u201d Andy testified. \u201cHe starts coming to the front, and I ask him if there\u2019s anything in his pocket, and he says no.\u201d<\/p>\n<p><!--]--><!--[--><\/p>\n<p>Carmack-Belton was telling the truth. But the Chows pursued him anyway.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Andy testified that as they ran down Springtree Drive, he saw the 14-year-old throw something to the right but did not stop to see what it was. He said the boy tripped and fell \u201cflat\u201d on the grass. He told jurors he raised his hands, backed away and yelled to his father, \u201cHe\u2019s got a gun.\u201d His father, he said, yelled for the teen to drop the gun and then fired a single shot.<\/p>\n<p><!--]--><!--[--><\/p>\n<p>Carmack-Belton \u201ctook a step or two, dropped the gun and fell to the ground.\u201d<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Kent asked Andy how he felt.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cTerrified. I thought (Carmack-Belton) was going to shoot me,\u201d Andy replied.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<h2>The disputed claim at the heart of the trial<\/h2>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>During cross-examination, Senior Assistant Solicitor Dale Scott pressed Andy.<\/p>\n<p><!--]--><!--[--><\/p>\n<p>\u201cWho put you and your father at that location on Springtree Drive?\u201d Scott asked.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cI put myself there,\u201d Andy responded, looking downcast.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cWho put your dad there?\u201d Scott pressed. \u201cDid you drag (your dad) along? Did anybody make (you and your dad) run up a hill 130 yards from your store, leaving the cash register unmanned?\u201d<\/p>\n<p><!--]--><!--[--><\/p>\n<p>Andy eventually testified that he and his father pursued the teen on their own.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cThe shooting doesn\u2019t happen if everybody stays put in the Shell gas station, correct?\u201d Scott asked.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cYes sir,\u201d Andy replied.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>When Kent on re-direct asked whether the shooting would have happened had Carmack-Belton not pulled a gun, Scott shot back on re-cross: \u201cYou don\u2019t even know there\u2019s a gun if you stay in the gas station, right?\u201d<\/p>\n<p><!--]--><!--[--><\/p>\n<p>\u201cYes sir,\u201d Andy answered.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<h2>A witness who stayed with Carmack-Belton<\/h2>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Among the prosecution\u2019s witnesses Wednesday was Lori Ann Carson, a grandmother of eight who was pulling into the gas station\u2019s parking lot when she saw the chase.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>\u201cHe looked frightened and scared,\u201d Carson said of Carmack-Belton. \u201cJust like a child who was in trouble.\u201d She told jurors she did not see anything in his hands as he ran.<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>Fighting back tears, Carson recalled finding the boy on his back, \u201cgurgling\u201d for air.<\/p>\n<p><!--]--><!--[--><\/p>\n<p>\u201cI didn\u2019t know CPR, so I couldn\u2019t help him, and that bothers me to this day,\u201d she said. \u201cAll I could do was remove the leaves from his mouth and just stay with him.\u201d<\/p>\n<p><!-- --><!--]--><!--[--><\/p>\n<h2>What comes next<\/h2>\n<p><!-- --><!--]--><!--[--><\/p>\n<p>The defense rested Friday afternoon after calling three witnesses: Andy Chow, a former sheriff\u2019s deputy and an EMS student who rendered aid to Carmack-Belton.
